Application of Returns for Exchange Policy
- Returns of products (“Products”) shall only be processed in terms of this Returns for Exchanges Policy.
- Should a customer (“You” or “the Customer”) wish to return for exchange any Product purchased from Chic on Repeat Pty Ltd, trading as Yomo (“Yomo”, or “Us” or “Our”) then this Returns For Exchange Policy shall apply and, in this case, please send your request to returns@dressyomo.co.za, or log a return under your registered user account.
- The law of South Africa applies to sales of products by Yomo to You. The Consumer Protection Act, 2008 (“CPA”), may apply in respect of the return of Products which, inter alia, do not comply with the implied warranty of quality. The provisions of the Electronic Communications and Transactions Act, 2002 (“ECTA”), may apply in respect of the return of Products purchased on-line, but apart from that South African law does not impose an obligation on a supplier to accept return of non-defective products.
- Nevertheless, as part of our added value for our customers, Yomo accepts returns for exchange of non-defective goods in accordance with the terms of this Returns for Exchange Policy. THE CUSTOMER IS LIABLE FOR FAMILIARISING ITSELF WITH AND FOR EXERCISING ANY OTHER APPLICABLE RIGHTS UNDER THE ABOVEMENTIONED LAWS OUTSIDE OF THIS RETURNS FOR EXCHANGE POLICY.
- All Yomo Products are stitched, sewn or otherwise created by professional designers, according to the South African or International retail sizes published in the size charts on the Yomo Website, which Customer selects as appropriate (and for which selection Customer is solely responsible), which process of Product creation can only begin once the Customer places an order for Products.
- YOMO IS NOT LIABLE FOR THE CUSTOMER SELECTING AN INCORRECT OR UNSUITABLE RETAIL SIZE IN THEIR ORDER, NOR FOR ANY OTHER ERROR OR MISTAKE BY THE CUSTOMER IN THE ORDER PROCESS, OTHER THAN WHERE YOMO HAS BEEN GROSSLY NEGLIGENT, AND THIS RETURN FOR EXCHANGES POLICY SHALL NOT APPLY IN THOSE EVENTS.
- THE CUSTOMER ACKNOWLEDGES AND AGREES THAT ITS ORDER IS MADE BASED ON THE DESIGN DRAWINGS PUBLISHED ON THE WEBSITE AND THAT AS THE PRODUCT DOES NOT YET EXIST IN PHYSICAL FORM, THAT ANY MINOR VARIATIONS OR MINOR DESIGN DEPARTURES FROM THE DESIGN DRAWING, AS IS NECESSARY IN THE PROCESS OF SEWING/ STITCHING/ CREATING THE PRODUCT, SHALL NOT BE GROUNDS FOR ASSERTING THAT THE PRODUCT WAS NOT MADE IN ACCORDANCE WITH THE CUSTOMER’S SPECIFICATIONS AND/OR IS NOT FIT FOR CUSTOMER’S PURPOSES.

Requirements
- For all return for exchange requests, we require:
- that the following be emailed to us:
- The invoice for the product or proof of purchase that meets our need to identify the sale in our records;
- The reason/s for the return in writing; and
- The product returned in the condition it was purchased and received in (excellent condition, undamaged, unworn, unaltered, and new), with all/any labels still attached and in its original packaging.
- that the following be emailed to us:
- If item 2.1.2. of this Returns for Exchange Policy is not complied with, reasonable charges may be imposed on you for minor restoration or restocking purposes per section 20 of the Consumer Protection Act 2008, if restoration or restocking is possible.
- If restoration/restocking of the Product is impossible or too expensive, an exchange will not be processed, and the Product will be returned to you at your cost.

Notice of Receipt and Decision
- Once the returned product is received and inspected by Yomo, we will send an email to notify you that we have received it. We will also notify you of the approval or rejection of your return for exchange request based on this Returns for Exchange Policy, no longer than 5 Business Days after the initial notification.

Returning Non-Defective Products

Non-defective Products may only be returned for the purpose of processing an exchange of similarly valued Products, or more valuable Products coupled with further payment by the Customer in respect of such additional value. All requests for exchange must be made per email, within 5 days of the receipt of the Products.

Please retain the Product in its original packaging, with labels attached, keep the Product and its packaging clean and undamaged, and do not wear, modify or use the Product, failing which this policy shall not apply.

THE RIGHT TO RETURN NON-DEFECTIVE PRODUCTS IS RESTRICTED AS:

THE APPLICATION OF SECTION 44 OF THE ECTA, CUSTOMER COOLING OFF RIGHTS, IS EXCLUDED PER THE SECTION 42 OF ECTA; AND

THE PRODUCTS ALSO FALL UNDER THE DEFINITION OF SPECIAL-ORDER GOODS UNDER THE CPA.

The Products are so classified in section 4.3 because, inter alia, the Products are:

made to the consumer’s specifications as explained in section 1.4 – 1.7 above and this clause below; and/or
-
may be clearly personalised; and/or
-
by reason of their nature cannot be returned, for the following reasons:

The Product has been made according to the specific order and size choice of the Customer which may not readily be resold until another suitable Customer comes along, if at all or if ever; and

The Product may have been already worn for the relevant event/occasion by the Customer or a related person, and/or may have been altered by the Customer for the relevant occasion/event.

Exchanges under this policy will be granted only for regular Products and not for sale, discounted or promotional Products, and depending on the availability of a suitable Product for exchange.

The creation of the Products has made Yomo already incur costs in the final creation of the Product, or through sourcing materials, or for the time and labour costs of the designers and other staff on working on the Product;

The Products are made for a specific Customer and for a specific occasion/event that the Customer or related person intends to attend;
- You will be required to deliver the returned Product by courier at your own cost and at your risk. You will also be required to pay for any costs relating to the delivery of any exchanged Product to you.
- If couriering the Product, please utilise a reputable courier company with a tracking facility.

Returning of Incorrectly Delivered or Defective Products
- Please retain the Product in its original packaging, with labels attached, keep the Product and its packaging clean and undamaged, and do not wear or use the Product.
- Please notify us requesting a return of the Product, and provide the items mentioned in 2.1.
- If a return is processed and validated in terms of this policy, the provisions of the Consumer Protection Act, 2008 apply to the return of the incorrectly delivered / defective products.
